1. Who We Are

When you purchase products on bonvale.nl (our "Website") or through our mobile application (our "App") as a customer in the Netherlands, you are entering into a contract with:

Bonvale UK Limited (company number 17142585), a company incorporated in England and Wales, with its registered office at 128 City Road, London, EC1V 2NX, United Kingdom ("Bonvale", "we", "us", "our").

Bonvale UK Limited is the seller and merchant of record for all products offered on our Website and App to customers in the Netherlands. We are established outside the European Union. This does not affect the consumer rights you hold under Dutch and EU law, which apply in full because we direct our commercial activities to consumers in the Netherlands (see Section 9).

Bonvale is a trademark of Bonvale Group Pte Ltd, used under licence.

2. About You

To purchase from us, you must:

  • be at least 18 years of age;
  • be purchasing for personal, non-commercial use;
  • have a valid payment method that we accept; and
  • be authorised to use that payment method (i.e. it is in your name or you have the permission of the cardholder).

By placing an order, you confirm that you meet all of the above requirements. We reserve the right to decline orders where we reasonably believe these requirements are not met.

3. Placing an Order

When you place an order on our Website or App, you will receive an acknowledgement email confirming receipt of your order. This email is a confirmation that we have received your order; it is not an acceptance of your order and does not form a binding contract.

A binding contract between you and Bonvale is formed when we send you a dispatch confirmation email confirming that your order has been shipped. The language of the contract is English.

We reserve the right not to accept your order where, for example:

  • we are unable to obtain payment authorisation;
  • a product is out of stock or has been withdrawn;
  • we identify a pricing error (see Section 5);
  • shipping restrictions apply to your delivery address; or
  • we have reasonable grounds to suspect fraudulent or unlawful activity.

If we are unable to accept your order, we will notify you as soon as reasonably practicable and provide a full refund of any amount charged.

All products remain the property of Bonvale until full payment has been received and the goods have been delivered to you.

4. Products

We sell fashion, apparel, accessories, and beauty and personal care products ("Products"). Product descriptions, images, and specifications on our Website are provided in good faith, but we do not warrant that they are entirely accurate, complete, or error-free. Minor colour variations between product images and the physical product may occur due to screen display settings.

We reserve the right to withdraw any Product from sale at any time without notice.

5. Pricing & Payment

5.1 Pricing

All prices displayed on our Website and App for Dutch customers are shown in Euro (EUR) and are inclusive of Dutch Value Added Tax (btw) at 21%, unless otherwise stated at checkout. Any customs duties and import taxes are calculated at checkout and included in your order total.

Prices are subject to change at any time without notice. The price applicable to your order is the price displayed at the time your order is accepted (i.e. at dispatch confirmation).

We take reasonable care to ensure pricing accuracy. In the event of a genuine pricing error, we will notify you as soon as possible and offer you the option to reconfirm your order at the correct price or cancel it for a full refund. We are under no obligation to fulfil an order placed at an incorrect price.

5.2 Payment Methods

We accept major debit and credit cards, accelerated checkouts such as Apple Pay and Google Pay, and the local payment methods and Buy Now, Pay Later services available in the Netherlands. The payment methods available to you are shown at checkout.

Payment is debited at the time your order is accepted (dispatch). Card details are processed through a secure, encrypted payment gateway. We store card details only where you have opted to save them on your account, and they are held in an encrypted environment.

5.3 Payment Processing

Payments are processed directly by Bonvale UK Limited via our payment gateway. Your bank statement may reflect a payment to Bonvale UK Limited or our payment processor (Shopify Payments).

6. Buy Now, Pay Later

Where a Buy Now, Pay Later ("BNPL") option is available at checkout, it is provided by a third-party credit provider under terms set by that provider and displayed to you before you select it. By choosing a BNPL option you enter into a separate agreement with that provider.

Bonvale is not responsible for the products, services, or terms of any BNPL provider. Any disputes regarding BNPL payments should be directed to the relevant BNPL provider. Borrowing beyond your means or paying late may negatively affect your credit status.

7. Delivery

We aim to dispatch orders within 1 business day of order acceptance. Orders placed after our daily dispatch cut-off, on a Sunday, or on a public holiday at our outbound warehouse will be dispatched on the next available business day. Estimated delivery timeframes are displayed at checkout and in your dispatch confirmation email. These are estimates only and are not guaranteed.

Bonvale insures each purchase while it is in transit until it is delivered to your specified delivery address. Risk in the goods passes to you on delivery.

We are not responsible for delays caused by customs clearance, postal disruptions, severe weather, or other events outside our reasonable control. If a significant delay is likely, we will contact you and offer you the option to cancel for a full refund.

If you have provided specific delivery instructions to the carrier, Bonvale is not liable for any loss or damage that occurs as a result of those instructions.

Please contact us at contact@bonvale.com within 30 days of the expected delivery date if your order has not arrived.

8. Returns & Refunds

8.1 Our Returns Policy

Subject to the exceptions set out below, we accept returns of unwanted items within 30 days of delivery, provided the item is returned in its original, unworn, unwashed condition with all original tags, labels, and packaging intact. This 30-day policy is offered voluntarily and is in addition to your statutory right of withdrawal under Section 9.

To initiate a return, log in to your account on our Website or App and follow the returns process. We will provide you with a prepaid return label. Drop your return at the location shown on your label.

Return shipping. We will cover the cost of return shipping for your first 2 change-of-mind returns in any rolling 30-day period. After this, a flat return shipping fee will be deducted from your refund. The current flat return shipping fee is set out in our Shipping & Returns policy on our Website. Because that fee is disclosed to you before purchase, it applies equally where you exercise your statutory right of withdrawal under Section 9. Where a return is made because goods are faulty, not in conformity with the contract, or do not match their description, we will bear the cost of return shipping in full.

Refund options. When you initiate a return, you may choose to receive your refund as either:

  • Store credit, issued to your Bonvale account as soon as your return parcel is scanned by the carrier at drop-off (typically within hours); or
  • A refund to your original payment method, issued within 14 days of our receiving your return. Your bank may take a further 3 to 10 business days to settle the refund.

We will not refund the cost of outbound delivery unless the item is faulty, incorrectly described, or you are exercising your statutory right of withdrawal under Section 9.

8.2 Non-Returnable Items

The following items cannot be returned or exchanged under our voluntary 30-day policy, except where they are faulty, not in conformity with the contract, or do not match their description:

  • Items marked as "Final Sale" at the time of purchase. However, if a Final Sale item is faulty or does not match its description, please contact support.
  • Underwear, intimate apparel, boxers, and socks, which are non-returnable for hygiene reasons where they have been unsealed after delivery.
  • Swimwear where the hygiene sticker or protective seal is not intact or labels have been removed after delivery.
  • Beauty and personal care products where the hygiene seal has been broken, tampered with, or removed after delivery.
  • Pierced jewellery where the hygiene seal has been tampered with or broken after delivery.
  • Store credit.

Your statutory rights are not affected. Nothing in this Section 8.2 excludes, limits, or modifies any right or remedy you have under Dutch consumer law. In particular, the statutory right of withdrawal in Section 9 is excluded only for sealed goods unsealed after delivery where return is not possible for health protection or hygiene reasons. If you receive a faulty or incorrectly described item, please contact us at contact@bonvale.com.

8.3 Faulty or Incorrect Items

If you receive a faulty or incorrectly supplied item, please contact us at contact@bonvale.com as soon as reasonably practicable after discovering the fault, with a description and photograph of the fault or error. We will arrange collection or return at our cost and offer you a repair, replacement, price reduction, or refund as provided by your statutory rights (see Section 9). Where you are entitled to a refund for a faulty or incorrectly described item, the refund will be issued to your original payment method and will include any outbound delivery charges you paid.

8.4 Condition of Returned Items

All returned items are inspected on receipt. Items returned worn, used, washed, altered, or otherwise not in their original condition will not be accepted for a change-of-mind refund under Section 8.1 and will be returned to you at your cost.

Where you exercise your 14-day statutory right of withdrawal (see Section 9), we may only reduce your refund to reflect any diminished value caused by handling that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods (for example, trying on a garment is acceptable; wearing it out is not). We will not refuse the withdrawal, charge a restocking fee, or apply an administration fee during this statutory period.

This Section 8.4 does not apply to faulty or non-conforming items, which are governed by Section 8.3 and your statutory rights under Section 9.

9. Your Consumer Rights

Bonvale respects the consumer protection laws of the Netherlands. The following provisions describe statutory rights that supplement or modify the general terms of this document. Where Dutch law confers rights that cannot be excluded or limited by contract, those rights prevail to the extent of any inconsistency with these terms.

Right of Withdrawal (Herroepingsrecht): Burgerlijk Wetboek

Under the Dutch Civil Code (Burgerlijk Wetboek), which implements the Consumer Rights Directive 2011/83/EU, you have the right to withdraw from your order within 14 days of the day on which you (or a third party you have nominated) receive the goods, without giving any reason.

To exercise your right of withdrawal, you must inform us of your decision by an unambiguous statement, at contact@bonvale.com or through the chat on any page of our Website, before the 14-day period expires. You may use the Model Withdrawal Form set out below, but it is not obligatory.

Once you have notified us of your withdrawal, you must return the goods to us without undue delay and in any event within 14 days of that notification.

Return shipping costs on withdrawal: You bear the direct cost of returning the goods, which is the flat return shipping fee set out in Section 8.1 and in our Shipping & Returns policy. We disclose this fee to you before you purchase. Where the goods are faulty or not as described, we bear the cost of return.

Refund on withdrawal:

  • We will reimburse the full purchase price and the cost of standard outbound delivery within 14 days of receiving the goods back, or within 14 days of you supplying evidence of return, whichever is earlier.
  • If you chose a delivery option more expensive than our least expensive standard delivery, we will reimburse an amount equal to the least expensive standard delivery option.
  • No restocking fee, administration fee, or handling charge is applied to a withdrawal within this statutory period.
  • We may reduce your reimbursement to reflect any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
  • Reimbursement is made using the same means of payment you used for the transaction, unless you expressly agree otherwise.

The right of withdrawal does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons and which were unsealed after delivery (see Section 8.2). This does not affect your rights in relation to faulty goods.

Your Rights for Faulty Goods: Legal Guarantee (Wettelijke Garantie)

Under Article 7:17 of the Burgerlijk Wetboek, the goods we deliver must conform to the contract. This means they must possess the qualities you are entitled to expect given the nature of the goods and what we have told you about them.

  • You have a legal guarantee of at least two years from delivery. Dutch law does not set a fixed maximum: the guarantee lasts as long as you could reasonably expect the product to last, taking into account the price paid and the nature of the product, which for some products is longer than two years.
  • To rely on the legal guarantee you should tell us about a lack of conformity within a reasonable time of discovering it. For consumer purchases, notice given within two months of discovery is always treated as timely.
  • Where goods do not conform, you are entitled first to repair or replacement, free of charge, and then to a proportionate price reduction or termination of the contract with a refund where repair or replacement is impossible, disproportionate, unsuccessful, or not provided within a reasonable time.
  • Where a lack of conformity becomes apparent within one year of delivery, it is presumed to have existed at delivery unless we prove otherwise.

Any commercial guarantee we or a manufacturer may offer is in addition to, and does not affect, this legal guarantee.

Where you are entitled to a remedy for non-conforming goods, we will also refund any outbound delivery charges you paid and bear the cost of return shipping.

10. Intellectual Property

The Website, App, and all content contained within them (including but not limited to text, images, photographs, graphics, product descriptions, logos, trade dress, and software) are owned by or licensed to Bonvale Group Pte Ltd and used by Bonvale UK Limited under licence. All such content is protected by applicable intellectual property laws worldwide.

Bonvale™ is a trademark of Bonvale Group Pte Ltd. You may not use the Bonvale name, logo, or any confusingly similar mark without our express prior written consent.

You are permitted to access and view content on our Website and App for your own personal, non-commercial use. You may not copy, reproduce, distribute, republish, transmit, scrape, data-mine, or commercially exploit any content without our express written permission.

11. Your Conduct

You agree that you will not misuse or tamper with our Website or App, including by introducing viruses, trojans, or other harmful material, carrying out denial-of-service attacks, or attempting to gain unauthorised access to our systems. You agree not to use automated systems or software to extract data from our Website ("screen scraping").

All purchases must be for personal, non-commercial use. You may not resell or commercially exploit products purchased from Bonvale.

If we reasonably suspect fraudulent, unlawful, or abusive activity on your account, we may suspend or close your account and refuse to process further orders.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Bonvale's total liability to you in connection with any order shall not exceed the total purchase price you paid for the relevant order.
  • Bonvale is not liable for any indirect, special, incidental, consequential, or punitive loss or damage, including loss of profits, loss of data, or loss of goodwill, whether arising in contract, tort, or otherwise.
  • Bonvale is not liable for failure or delay in performance caused by events outside our reasonable control, including natural disasters, industrial action, government action, or failure of third-party services.

Nothing in these Terms & Conditions limits or excludes our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, for defective products under the product liability provisions of the Burgerlijk Wetboek, or for any other liability that cannot lawfully be excluded under Dutch law.

Nothing in this section limits your rights under the Burgerlijk Wetboek or any other mandatory Dutch consumer protection law (see Section 9).

13. Dispute Resolution

13.1 Pre-Dispute Notice

Before initiating any formal claim, we encourage you to first give Bonvale an opportunity to resolve your complaint. Please send a written notice to contact@bonvale.com with the subject line "Formal Dispute Notice". Your notice should include: (a) your full name and account details; (b) a description of the issue and the specific resolution you are seeking; and (c) any relevant order numbers or transaction references.

We will acknowledge receipt within 5 business days and endeavour to resolve your complaint within 30 days of receiving your notice.

Nothing in this Section 13.1 requires you to provide such notice before exercising your statutory rights, and it does not limit your right to bring a claim in the courts or through a consumer dispute body at any time.

13.2 Courts

As a consumer, you may bring proceedings against us in the Dutch courts. We may bring proceedings against you only in the Dutch courts. This reflects your protection under EU rules on jurisdiction in consumer contracts and is not affected by Section 14.

13.3 Alternative Dispute Resolution

If we cannot resolve your complaint between us, you may seek information and assistance from the Netherlands Authority for Consumers and Markets (Autoriteit Consument & Markt) through its consumer information service ConsuWijzer at consuwijzer.nl.

14. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales.

This choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under Dutch law. As a consumer habitually resident in the Netherlands, you retain the full benefit of the mandatory Dutch consumer protection rules where they are more protective than the chosen law.

15. Store Credit

From time to time we may issue store credit, including as a refund option (where you elect to receive store credit instead of a refund to your original payment method), as a goodwill gesture, or as part of a promotion.

Store credit is issued in the form of a digital code or balance applied to your Bonvale account, and is valid for 12 months from the date of issue. Any balance remaining after 12 months will expire and cannot be redeemed.

Unless we state otherwise:

  • Store credit may only be redeemed against the purchase of products on our Website or App. It cannot be redeemed for cash, exchanged, or transferred to another person or account.
  • Store credit has no cash value and does not earn interest.
  • Store credit may be applied across multiple orders; any unused balance remains on the credit until expiry.
  • If a product purchased with store credit is later returned, any refund will be issued back to your store credit balance, with the original expiry date preserved.
  • We may suspend or cancel store credit if we reasonably believe it has been obtained or used fraudulently or in breach of these Terms & Conditions.

Nothing in this Section 15 limits or excludes your statutory rights. Where you are entitled to a statutory reimbursement (for example, on withdrawal within the 14-day period or where goods do not conform), the reimbursement will be made in money using the same means of payment you used for the transaction, unless you expressly agree to accept store credit instead.

16. Promotional Codes

From time to time we may issue promotional codes (including discount codes and offer codes) for use on our Website or App. Promotional codes are subject to the specific terms displayed at the time of issue (including expiry date, minimum spend, eligible products, and use limits). In addition, the following terms apply unless we state otherwise:

  • Each code is valid for one use per customer.
  • Codes have no cash value, are non-transferable, and cannot be exchanged for cash.
  • Codes cannot be combined with any other promotional code or offer.
  • Codes do not apply to store credit, shipping charges, or items marked "Final Sale".
  • Codes must be entered at checkout; we cannot apply a code retroactively to an order that has already been placed.
  • We may withdraw, cancel, or amend a promotional code at any time, including where we reasonably believe it has been used fraudulently, copied, or shared without authorisation.

If you return an item purchased using a promotional code, any refund will be calculated based on the discounted price you actually paid.

17. Privacy

Our collection and use of your personal information is governed by our Netherlands Privacy Policy, which is available on our Website. The Privacy Policy forms part of these Terms & Conditions.

Our Privacy Policy sets out the lawful bases on which we process your personal data and the rights you hold under the General Data Protection Regulation (EU) 2016/679 and the Dutch GDPR Implementation Act (Uitvoeringswet AVG).

18. Amendments to These Terms

We may update these Terms & Conditions from time to time. The latest version will always be published on our Website, together with the effective date. We will notify you of material changes by email or by a prominent notice on our Website prior to the changes taking effect.

Continued use of our Website or App after the effective date of any change constitutes your acceptance of the updated terms. If you do not agree to a change, you should stop using our Website and App.

Any amendment to these Terms & Conditions will not affect orders you have already placed.

19. General

Entire agreement: These Terms & Conditions, together with our Privacy Policy and any product-specific terms, constitute the entire agreement between you and Bonvale in relation to your use of our Website, App, and purchase of our Products. This does not limit any right you have under mandatory consumer law.

Severability: If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

No waiver: Our failure to enforce any provision of these Terms & Conditions shall not constitute a waiver of our right to enforce it in the future.

Assignment: We may assign our rights and obligations under these Terms & Conditions to any member of the Bonvale group or to a successor entity in a merger or acquisition. Any assignment will not reduce your rights under these Terms or applicable consumer law. You may not assign your rights or obligations without our prior written consent.

Third-party rights: Except as expressly provided, no person other than you and Bonvale has any right to enforce any term of these Terms & Conditions.

No partnership: Nothing in these Terms & Conditions creates a partnership, joint venture, employment, or agency relationship between you and Bonvale.
